Abstract

This research is about the contract of Istisna‘ (manufacturing contract)

discussed in the light of Hanafi jurisprudence. It presents the evidences for

its legitimacy, the opinions of Hanafi jurists, related discussions, and

conclusions. This topic is among the important issues because people need

Istisna‘ contracts, as they help facilitate people's lives and solve many

problems. Some individuals need certain items to be manufactured, but

such items may not be available in the community; others possess skills but

are in need of money. Through the Istisna‘ contract, these problems can be

solved for both sides.The purpose of this research is to make more people

aware of the Hanafi scholars’ views and the related rulings of the Istisna‘

contract. This research is qualitative and based on textual analysis,

benefiting from various theoretical books. It covers the definition of

Istisna‘, evidences for its permissibility, the opinions of Hanafi jurists, its

conditions of validity, and the rulings related to Istisna‘. In the end, the

research concludes that the Istisna‘ contract is permissible according to

Hanafi scholars, supported by evidence from the Qur’an and Prophetic

Sunnah, and they have also transmittedpracticalconsensusregarding it.
